06/01/2010 – Anyone who does not secure their WLAN is liable!

The Federal Court of Justice ruled that anyone who does not secure their wireless network adequately or not at all risks a warning if third parties use it unlawfully.

Private individuals can therefore be sued for injunctive relief, but not for damages, if their insufficiently secured wireless network is used by unauthorized third parties for copyright infringement on the Internet.

The judgment also has far-reaching effects on the Freifunk movement and on providers of free networks such as cafes and hotels. Because they too risk being reported. Just like parents whose kids are surfing through the router at home and doing illegal downloads or attacks. The wireless network must be protected at all times according to the current state of the art.
